Court of Appeal confirmed Arbitrary Court of Moscow judgment on admission Federal Anti-Monopoly Service (FAS of Russia) decision on oil spill response (LARN).
Association filed claim to FAS of Russia seeking for examination of validity of Petersburg sea port Administration order on compulsory and additional certification of oil spill response teams working at the Saint Petersburg sea port by Central Attestation transport Commission of Russia (CAC).
Till the middle of 2008 prevention and elimination of oil spills at Saint Petersburg sea port was performed by more than a dozen organizations certified according to Russian legislation stipulated in the federal law “Concerning Accident Rescue Services and the Status of Rescuers”. All oil spill response teams were certified by Interdepartmental attesting commission (MAC). But in May 2008 Rosmorrechflot and Petersburg port Administration required additional compulsory certification of oil spill response teams according procedure established by Transport Ministry of Russia.
FAS stated that establishing of special requirements to oil spill response organizations established by Federal Transportation Inspection Service submitted to Transport Ministry of Russia had negative impact of competition at the market of oil spill elimination services at sea ports and are compulsory for administrations of all ports in the Russian Federation.
